In an article published in the Rural Law Review, Professor Theodore Georgopoulos offers a critical analysis of the European Commission’s "Questions and Answers" opinions issued in late 2023 and early 2024 on electronic labelling and the dealcoholisation of wine.
While aiming to clarify Regulation (EU) No 2021/2117 – whose provisions are admittedly ambiguous in parts – they mark a shift toward implicit normative production that circumvents the safeguards of the EU’s formal legislative process.
Theodore Georgopoulos highlights the potential risks of such a regulatory method, which may weaken legal certainty for operators and disrupt the consistent application of EU law.
