10 December 2019 : Trademark reform package implemented in France - Adoption of one fee per class system
Significant Modifications to French Trademark Law
The final decrees necessary to transpose Directive (EU) 2015/2436 of the European Parliament and of the Council of 16 December 2015 were published on December 10, 2019.
The reform introduces significant modifications modernizing and harmonizing French trademark law. The provisions regarding trademark filings and renewals are immediately applicable.
This news flash covers only the new official fee structure for French trademark applications and renewals. Other news flashes will follow explaining the other important modifications, in particular to the opposition procedure as well as cancellation and revocation actions.
As of December 11, 2019, the fee structure for French trademark applications and renewals has been modified to adopt a one fee per class system.
The new fees are set forth below :
Applications
Official fees | Casalonga fees | |
First class | € 190 | € 400 |
Supplement for each of the second and third class | € 40 | € 20 |
Supplement for each additional class | € 40 | € 80 |
Renewals
Official fees | |
Renewal in one class | € 290 |
Supplement for each additional class | € 40 |
Given the very significant increase in the official fees for renewals, Casalonga will not modify its renewal fees for French trademark registrations that expire in 2020. The change in the official fees will impact, however, any renewal fee estimates previously provided.
