June 1st 2023 - D-Day for patents in Europe

The Unified Patent Court (UPC) opens its doors today June 1st.

Infringement and revocation actions of European patents may now be brought before one of the various local divisions or the central division of the UPC, and a single decision will be issued instead of several decisions by national courts.

Revocation actions of European patents involving pharmaceuticals, electronics and telecommunication, physics, fixed constructions, and textiles are brought before the central division based in Paris.

Simultaneously, a Unitary patent is created. This is the single patent of the European Union which has been awaited since 1977 when the European Patent Office (EPO) began to examine and grant “European patents” having in reality only the effects of national patents after grant.
Now, the EPO will be responsible for the grant of not only the usual European patents but also the Unitary patents covering already 17 EU countries and requiring only one translation and one annual fee.
