POLAROID CORPORATION v/ DECATHLON
Polaroïd Corporation was represented by Arnaud Casalonga, Attorney at Law.
It was found that Decathlon manufactured and marketed sunglasses reproducing various names and notably POLAROID.
Polaroïd Corporation launched trademark infringement and unfair competition actions against Decathlon.
The Court ruled in favor of Polaroid Corporation with respect to the acts of infringement and considered that the name POLAROID, affixed on the sunglasses’ labels,was not distinct from the other names to which it was associated.
The Court also ordered Decathlon to pay damages for unfair competition after having found that its spectacle lenses were of a lower quality.
