The Hasbro companies, which are the exclusive licensee and user of the semi-figurative trademark “BEYBLADE METAL FUSION”, as well as registered community designs of spinning tops, were informed by the customs authorities that copies were retained and noted that litigious products were commercialized on the Internet.

Therefore, the Hasbro companies brought an action against the author of the disputed facts for trademark and design infringements, as well as unfair competition practices.

The Paris Court of Appeal confirmed the infringements and sentences relating to them, and sentenced the defendant to pay a supplementary compensation for unfair competition practices, considering that the fact that the products were retained does not eliminate damages suffered by unfair competition practices.
