The Heyraud company, a famous French tanner since 1913, has sued Cosmoparis and San Marina companies for copyright infringement on its model of woven boots.
The Paris Court of Appeal considered that Heyraud’s action was admissible and recognized the model’s originality due to the choice of materials, proportions and shapes, and the combination of the elements invoked according to a particular layout, giving it an individual appearance.
The defendants were sentenced for counterfeited acts, the only differences between Heyraud’s design and the litigious design being negligible and did not change the models’ overall impression.
