August 2018 – An action before the German constitutional Court stops temporarily the ratification process of the UPC in Germany

In mid-August, was suddenly published the action lodged before the German constitutional Court against ratification of the UPC agreement in Germany. The action lodged by a German lawyer, Ingve Stjerna, argues that the UPC agreement would be contrary to the German constitution in that it would reduce the sovereignty of Germany. In addition, the vote of the German Bundestag accepting to ratify the UPC agreement would have been obtained with an insufficient majority.

This action has put a stop to the ratification process in Germany.

It is now necessary to wait for a decision of the Constitutional Court before the ratification process could start again.

It is now difficult to make any forecast for the entry into force of the UPC and whether it will extend to the United Kingdom after Brexit.
