CASALONGA is launching the first Interactive Code of the Unified Patent Court (UPC) texts

The forthcoming entry into force of the UPC will significantly impact strategies for protecting and defending intellectual property rights in Europe. The UPC will be competent to judge the infringement and validity of European Patents and Unitary Patents (European Patents with Unitary Effect).

Casalonga is launching the first free, interactive and annotated Code that compiles all of the Unified Patent Court (UPC) texts.

The product of over two years of study and development by the Casalonga team, this interactive Code will enable practitioners to not only easily navigate through all of the UPC texts but also to better understand the system thanks to a number of commentaries.

Anticipating the challenges that IP professionals will face, the accessibility to the UPC texts offered by the Code ensures a solid understanding of the UPC prior to its entry into force and consequently the ability to construct and adapt protection strategies accordingly.

A GLOBAL PLATFORM

As the Unified Patent Court’s operations will be entirely new and relatively complex, the platform provides for the interactive and easy consultation of all of the relevant texts :

  • Rules of procedure
  • UPC Agreement
  • UPC Statute
  • Mediation and Arbitration Rules
  • Schedule of court fees ; Guidelines for litigation value ; European Patent Litigation Certificate ; Rules of conduct for Representatives.

A PLATFORM ACCESSIBLE TO EVERYONE

The platform is intended for all intellectual property professionals worldwide : patent and innovation practitioners, attorneys-at-law, patent attorneys, lawyers, judges, inventors, patent applicants, professors, researchers... wishing to file, protect or defend a patent in Europe.

Easily accessible via a simple registration process, the online Code is available in English with the French and German versions to follow shortly (the three official languages of the texts).

This tool was designed to respond to a context where the stakes are high for IP professionals. They find themselves in a new environment and must quickly confront the changes that this entails. Our review and in-depth analysis of these new texts, which are complex to say the least and include numerous cross-references, convinced us of the need to develop this tool. Developed to enhance the relationship between professionals and the new system, the objective is to enable practitioners to better understand the new applicable regulations, to have an overview and clear insight, and to better grasp the stakes of the UPC”, adds Marianne Gabriel, the partner that initiated the project.
