April 16, 2013 - Unitary Patent: the action filed by Spain and Italy dismissed!

The EUCJ (European Union Court of Justice) has just issued an important decision on April 16, dismissing the action which had been filed by Spain and Italy against the Regulation on the Unitary patent.

These two countries were trying to block the Unitary patent on the basis of an alleged breach of the EU treaty.

The EUCJ, in rejecting all the arguments of Spain and Italy, fully justified the enhanced cooperation which allowed the EU Council and the EU parliament to accept the creation of a Unitary patent right for only 25 member states of the EU (the EU comprises today 27 member states)

This important decision completely clears the way for the ratification of the Unified Patent Court agreement and entry into force of the Unitary patent which is expected in 2014 or beginning 2015.

Before his arrival at CASALONGA, he has about two years legal work experience in the fields of Intellectual Property for protecting and defending the client's IP rights (Trademarks, Patents and Designs etc.) in a big European IP Law firm.

Graduated with a Bachelor's degree in Law in China and a Master Degree in Intellectual Property Law in France, he has acquired IP professional experiences in France and at the European level, regarding notably the French and Community Trademarks, Designs, as well as Domain names. Having many exchanges with foreign partners and clients, notably with Chinese, he will help us to provide our Chinese clients with high-quality and more adequate legal services, for example,

contacting and answering to the legal inquiries directly in Chinese in order to ensure our quick and efficient communications with our Chinese clients (China PR and Taiwan);

better understanding the needs of our Chinese clients in order to provide promptly with our best legal advices and defend their rights in Europe;

providing with the legal services meeting the special needs of our Chinese/Taiwanese clients, for example, Chinese characters Trademarks searches and watching services etc.

In addition, with his experiences of multiple participations in Chinese trademark filing strategies preparations and in divers anti-counterfeiting files for many big French companies, he will help us to defend firmly and promptly our European clients' IP rights in China.

February 19, 2013 - The Agreement on the UPC has been signed!

The Agreement on the Unified Patent Court has been signed on February 19, 2013 by almost all EU member states, including Italy.

Please refer to our previous note of January 2013 for more details on the Unified Patent Court and the Unitary Patent.

It is expected that the UPC together with the Unitary patent regulation could enter into force before June 2014 after ratification of the agreement by at least 13 EU member states (including France, Germany and United Kingdom).

In the mean time, the Rules of procedure for the UPC will have to be finalized and the level of the renewal fees for the Unitary patent determined.The local and regional divisions of the court of first instance will have to be decided and organized in the various contracting member states.

The organization of the central division located in Paris is presently already under way.

Seminar outline:

The new European Unitary Patent and Court is the most important change in patent law in Europe in the last 40 years.

The new system may be launched as early as 2014. All US companies and practitioners should get prepared and know about the advantages and inconveniences of the system prior to its launch.

The seminar will discuss patent filing strategies and litigation before the Unitary Patent Court. This will include strategic views on the new choices for patent protection and for litigation.

Although this is a unified system, there will be differences in approaches at the various locations of the local court divisions and US companies may prefer to bring cases before the central division.

The aim of this seminar is to give US companies and practitioners strategic information and practical advice.
