TJ Paris, référé - Association LIGUE FRANCAISE POUR LA PROTECTION DES OISEAUX c/ Association FEDERATION NATIONALE DES CHASSEURS & SA SOCIETE MARKETING PUBLICITE 2000

La SOCIETE MARKETING PUBLICITE 2000, agence de communication de la FEDERATION NATIONALE DES CHASSEURS (FNC), était représentée par Arnaud CASALONGA et Juliette DIONISI, avocats au Barreau de Paris.

Estimant que la brochure intitulée « La chasse, cœur de biodiversité », réalisée pour la FNC par son agence, et adressée à près de 600.000 élus, reprenait les éléments de sa charte graphique, portait atteinte aux droits qu’elle défend et reproduisait sans autorisation ses marques « AGIR pour la BIODIVERSITE », la LIGUE FRANCAISE POUR LA PROTECTION DES OISEAUX (LPO) a assigné en référé la FNC et la SOCIETE MARKETING PUBLICITE 2000 en parasitisme et contrefaçon de marque.

Par ordonnance du 18 octobre 2021, le Président du Tribunal judiciaire de Paris a rejeté toutes les demandes de la LPO tant sur la contrefaçon de marques que sur le parasitisme.

En outre, s’agissant de la troisième action engagée par la LPO à l’encontre de la FNC et de son agence de communication, la LPO a été condamnée à payer la somme de 7.000 euros à chacune au titre de l’article 700, soit 14.000 euros au total.

Paris Court of Appel - SAS MAISONS DU MONDE France v/ SA LEROY MERLIN, SAS BENOIT LE TAPIS BROSSE & SAS ALSAPAN

LEROY MERLIN was represented by Arnaud CASALONGA, Attorney at Law.

Considering that a doormat and a collection of industrial style furniture commercialized by LEROY MERLIN and BENOIT LE TAPIS BROSSE reproduced the combination of the distinctive elements of its "Atelier" doormat model and its "Docks" range of furniture, SAS MAISONS DU MONDE sued SA LEROY MERLIN, SAS BENOIT LE TAPIS BROSSE & SAS ALSAPAN before the Paris Commercial Court on the grounds of unfair competition and parasitism.

By a judgment rendered on April 8, 2019, the Paris Commercial Court ruled against LEROY MERLIN and BENOIT LE TAPIS BROSSE on the basis of unfair competition for the doormat model but dismissed MAISONS DU MONDE’s claims relating to the industrial furniture.

In its decision of June 15, 2021, the Court of Appeal of Paris rejected all of MAISONS DU MONDE’s claims both based upon both unfair competition and parasitism.
